Translating The Constitution

I accept merely posed a draft of my latest piece, Translating the Constitution, on SSRN. This is a review of Larry Lessig's novel book, Fidelity as well as Constraint, as well as expands on my contribution to our recent symposium on the book.

Here is the abstract:

Lawrence Lessig's recent book, Fidelity as well as Constraint: How the Supreme Court Has Read the American Constitution (Oxford University Press, 2019), restates as well as expands his of import as well as influential theory of interpretive fidelity equally translation.

This mass review is inwards iii parts. Part One explains why, although Lessig's theory is based on fidelity to master meaning, his originalism is dissimilar close contemporary versions. Indeed, despite his metaphor of translation, Lessig is non truly a textualist at all. Unlike close contemporary originalists, he pays relatively niggling attending to parsing the words of constitutional text, or to their history. Instead, he is a purposivist as well as structuralist, who argues that fidelity to work as well as construction inwards changed contexts may sometimes justify departing from the text or adding things to the text.

Part Two examines Lessig’s work of the concept of social pregnant to explicate as well as justify many of the Supreme Court’s close famous liberal decisions, including Brown v. Board of Education, the gender activity equality cases, the reproductive rights cases, as well as the gay rights cases. Lessig's concept of "social meaning" truly refers to changes inwards elite consensus with the relatively modest groups of elites who course of educational activity the audience for Supreme Court Justices. Lessig's arguments are an imaginative restatement of the American Legal Process tradition, but using a different vocabulary. In an historic menstruum of polarized elites similar today, however, Lessig's social pregnant draw concern human relationship threatens to intermission down, equally Lessig himself recognizes.

Part Three considers whether a purely internalist theory of constitutional alter similar Lessig’s is adequate to explicate the increment as well as evolution of the American Constitution. It argues that Lessig’s draw concern human relationship of alter relies besides much on how the globe looks to the Justices, rather than on how the globe truly changes; it also relies besides much on winner's history. His draw concern human relationship could hold upwards made stronger past times focusing on the role of political parties, social movements, as well as state-building inwards constitutional change; as well as the long-term construction of judicial review past times the political branches. The resultant would no longer hold upwards purely internalist. But it mightiness hold upwards a to a greater extent than powerful draw concern human relationship of the complicated processes of constitutional change.
